This Responsible Use Policy ("RUP") supplements the Terms of Service between Podium Markets Media, LLC. or its affiliates ("Podium") and its affiliated companies and subsidiaries worldwide ("us", "our", "we", the "Company") and you (the "Customer"), governing the use of Podium's Platform, Website, and services (the "Platform" and/or "Website"). The RUP applies to your access and use of the Website Customer Data (including the Input Data you provide to the Platform and the Generated Output created on its basis), whether as part of your Platform or your use of Generated Output outside of it. Capitalized but undefined terms used in the RUP have the meanings set forth in the Terms of Service.

You will not share with the Platform any Input Data that, nor knowingly use the Platform to generate any Generated Output or use or make available to others any Generated Output that doe the following:

Prohibited uses

• Violates any applicable national, federal, state, local or international law or regulation;

• Exploits, harms or attempts to exploit or harm minors in any way;

• Contains pornographic, sexually explicit, or adult content;

• Generates or disseminates verifiably false, misleading or deceptive information and/or content (including with regard to medicine, health and science);

• Generates or disseminates personally identifiable information that can be used to harm an individual;

• Generate or Disseminates information and/or content (e.g. images, code, posts, articles), and place the information and/or content in any context (e.g. bot generating tweets) without expressly and intelligibly disclaiming that the information and/or content is machine generated;

• Defames, disparages, cyber-bullies or otherwise harasses others, or encourages self-harm or harm to others;

• Impersonates or attempts to impersonate (e.g. deepfakes) others without their consent;

• For fully automated decision making that adversely impacts an individual's legal rights or otherwise creates or modifies a binding, enforceable obligation;

• Discriminates against or harms individuals or groups;

• Exploits any vulnerabilities of a specific group of persons based on their age, social, physical or mental characteristics, in order to materially distort the behavior of a person pertaining to that group in a manner that causes or is likely to cause that person or another person physical or psychological harm;

• Engages in political lobbying or campaigns to actively influence the decisions of government officials, legislators, or regulatory agencies on legislative, regulatory, or policy matters;

• Engages in and promote regulated services and professions, and/or deliver any regulated products or services, including but not limited to legal and accounting services, investment advice, insurance, banking and securities, without having the qualifications, licenses and permits required by applicable law;

• Infringes, violates or misappropriates any patent, trademark, trade secret, copyright, or other intellectual property or other proprietary rights of any other person;

• Transmit or otherwise makes available any malicious code, including any virus, worm, trojan horse, time bomb, web bug, spyware, or any other malicious or harmful computer code, library, file, or program; and

• Circumvents the technical and other safeguards set out by the Company or its Third- Party Service providers meant to ensure adherence with the RUP and such Third-Party Service providers' equivalent usage policies, as applicable.

Notification and enforcement

To the extent the Platform generates Generated Output containing any of the above, you will notify us in writing without undue delay upon becoming aware of it.

Enforcing the RUP, including the determination whether a violation occurred and determining its severity, is at the Company's sole and complete discretion, and failure to enforce it in one instance does not constitute a waiver to enforce it in any other instances.

You will promptly cease use of any Customer Data, Input Data or Generated Output violating this RUP, and the Company has the right to promptly remove or delete any violating Customer Data, remove violating Generated Output from the Platform and Website in its sole discretion or modify the Platform to ensure compliance with the RUP and applicable law.
